Schengen visa application guidance 

 

Dear Visa Applicants,

It is our honour to inform you, that from 1st of September 2022 Hungary represents the Republic of Malta concerning of issuing of Schengen short stay visas at the Embassy of Hungary in Pristina.

The practice and system of requirements for issuing Schengen short stay visas are the same as the practice and system of Hungary’s. Please, when applying for Schengen visa to the Republic of Malta, fill in the declaration proof  as well.

 

Basic information on Schengen Visa

Based on the list of the short stay visa waiver agreements, citizens of the Republic of Kosovo do not need a visa to travel to Hungary. 

Other third country nationals, who are visa required  shall apply for a Schengen Visa in order to travel to Hungary and/or to other Member States. Please note, that according to the Regulation (EC) No. 810/2009 of the European Parliament and of the Council of 13 July 2009 estabilishing a Community Code on Visas (Visa Code) Article 6, an application may be accepted from a person legally present – but not residing – in the jurisdiction of the consulate where the application is submitted, if it is justified why the application could not be lodged at a consulate in his/her place of residence. It is for the consulate to evaluate whether the justification presented by the applicant is acceptable. It means that third country nationals have to be in a possession of a valid residence permit issued by authorities of the Republic of Kosovo.

A Schengen Visa authorizes the bearer to a single, double or multiple entries and, in case of an uninterrupted stay, to a stay of maximum 90 days, while in case of an interrupted stay, to a stay of alltogether maximum 90 days within 180 days counted from the date of the first entry.

The Schengen visa does not mean an automatic permission to enter the Schengen area. At the border, the conditions of the entering and planned staying in the territory of the Member States can still be examined.

When to apply at the Hungarian Embassy in Pristina?

 

  • if your sole destination is Hungary,
  • if the visit includes more than one destination, or if several separate visits are to be carried out within a period of 2 months, but the main destination of your travel is Hungary in terms of the length or purpose of stay,
  •  if no main destination can be determined, and if you enter the Schengen Zone for the first time at the trough the border of Hungary.
  • If you would like to transit through Hungary:
  • 1) if you transit through Hungary only,
  • 2) in case you transit through more than one Member State, but the first one is Hungary.

Please note that the purpose of transit is no longer in the Visa Code!

 

The visa application shall be submitted no longer than 6 months before the start of the intended visit, and no later than 15 calendar days! In justified individual cases of urgency, the consulate may allow lodging of applications later that 15 calendar days before the intended start of the visit.

 

What If I’m a family member of an EU/EEA citizen?

If you are a family member of an EU/EEA citizen you may qualify for an accelerated free visa procedure as long as you meet the following criteria:

(1) You are a family member (this includes a spouse, registered partner, child under 21 or a depending

family member) of an EU/EEA or Hungarian national (or of his/her spouse/registered partner); AND

(2) That EU/EEA national is residing in Hungary; AND

(3) You are accompanying the EU/EEA or Hungarian national or planning to join him/her for residence.

Supporting documents to attach:

  • proof of relationship with the EU/EEA national, registered in the competent EU/EEA country
  • accomodation in Hungary
  • proof of financial means

 

What If I’m a family member of a Hungarian citizen?

If you are a family member of a Hungarian citizen and you wish to join him/her for residence, you needto apply for a residence permit at the embassy. The Immigration and Asylum Office decides on the application, personal interview is conducted during the procedure.

Supporting documents to attach:

  • Proof of relationship (birth certificate or marriage certificate registered with the Hungarian authorities)
  • Photocopy of the ID card or passport of the Hungarian family member
  • Proof of sufficient financial means (employment contract, pay slip of the family member or bank account statements of all accounts up to three months);
  • Declaration of financial support from the family member who sponsors the residence permit applicant certified by public notary;
  • Confirmation of prearranged accommodation (commercial accommodation or lease agreement along with the property sheet form the land register related to the latter);
  • Travel insurance for at least the first 30 days of stay (minimum coverage shall be EUR 30 000)

 

Visa fee

Schengen visa – 90 EUR

For child between 6-12 years – 45 EUR

For child under 6 years –  free of charge

The visa fee is 35 EUR for those citizens, who are under the EU Visa Facilitation Agreements.

 

Decision on the application

 

According to the Visa Code Article 23, the decision making period is 15 calendar days, which can be extended maximum up to 45 days calendar days.

 

 Appeal

In order to submit an appeal application, an appointment must always be made through the online appointment system. Appointments are made through the online APPOINTMENT SYSTEM.

 

Required documents for appealing:

  • Appeal statement: Written in the official language of the European Union, practically in English or Hungarian.
  • New additional supporting documents: Documents to support the application that have not been previously submitted.

Appeal applications must be submitted to the related authority that rejected the submitted application. If the person applied at the  Embassy of Hungary in Pristina, appeal application must be made through the Embassy of Hungary in Pristina.

The appeal decision is made in 15 days by the Minister of Foreign Affairs and Trade of Hungary.
